THIS AGREEMENT made this ___________________ between J&B Rv Ranch and Boat Storage Facility 150 M and M Ranch Rd (hereinafter called "Dealer") and __________________________________ (hereinafter called "Owner") WHEREAS, Owner owns a Boat, Motor Home, and/or Trailer with certain accessories, which is described as follows: (TX Reg. Number, year, description of Boat/RV, motor, serial numbers, etc.) _____________________________________________________________________________________ NOW THEREFORE, in consideration of the mutual covenants herein contained, the parties agree as follows: 1.Dealer agrees to accept the Boat/RV for storage inside or outside storage space upon advanced payment by Owner of a storage fee of 115$/135$/150$ per month for covered storage and $50 per month for outside storage, for the storage period of month to month at ______________________ a month. Electric hook up is solely to keep batteries charged on unit. Dealer is not responsible for any loss of items due to electrical hookup. If the electricity is being used for any other reason dealer can unplug unit and apply a 50$ fee. Owner shall remove from the Boat/RV all items of personal property not covered by the terms of this agreement prior to delivery of the Boat to Dealer for storage. The storage provided by this agreement shall be solely at Owner's risk and Owner hereby releases Dealer of all liability for any loss or damage to the Boat/RV and any other property of Owner whatsoever, whether or not such loss or damage shall have been caused by the fault or negligence of Dealer or any of Dealer's employees, agents, licensees or invitees. In the event Owner shall change Owner's place of residence as set forth in the storage agreement, Owner shall give Dealer written notice of any change within ten (15) days of the change, specifying Owner's current residence and telephone number. In the event of a late fee. afterwards until unit is paid in full. If dealer is not paid by the 1st of the month a $25 late fee will be charged and $5 dollars per day every day Dealer reserves the right to move the Boat/RV to any other storage space as Dealer may find necessary. Owner shall hold harmless Dealer, its agents and employees, from and against any expense (including, without limitation, legal and collection fees) loss or liability suffered or incurred by Dealer or any third party as a result of or in connection with any breach by Owner of Owner's obligations as set forth in this agreement. Owner shall carry insurance against loss by fire, theft, windstorm and other damage or loss which may occur during the rental period or as a result of Owner's failure to carry out Owner's obligations under this agreement. Owner's Boat/RV will be subject to a claim of a lien in favor of Dealer. If rent or other charges due are delinquent 14 days after the due date. Owner expressly consents to the Dealer taking full control of the equipment stored on the premises if Owner defaults in any way under this agreement. 10. This storage agreement shall terminate at the expiration date stated within. Either party may terminate this agreement by giving the other party ten (15) days written notice by written notice. In the event the Owner terminates prior to the expiration of the storage period or in the event Dealer terminates due to default of Owner in the performance of the terms and conditions of this agreement, any storage fee paid by the Owner shall be retained by Dealer and shall not be refunded or prorated. These Campground Rules and Regulations are incorporated herein by reference to the J&B RV Park Guest Agreement Terms and Conditions (“Agreement”). Guest hereby agrees to comply fully with all of the Campground Rules and Regulations set forth herein. Guest further agrees that if Guest fails to comply with any of the Rules and Regulations set forth herein, Guest will be in default of the Agreement and J&B RV Park Management, Inc., J&B Rv Ranch and boat storage facility LLC will be entitled to all of the remedies set forth in the Agreement, including but not limited to the immediate removal of Guest from the RV Park. J&B RV Park shall also be entitled to recover its damages, including attorney’s fees and costs incurred in enforcing the Agreement and these Campground Rules and Regulations.
Guest is not allowed to sublet his or her RV within the RV Park. If Guest sells or transfers title to the RV, the RV must be removed from the RV Park within 24 hours of the transfer of title, unless the new owner enters into a new Agreement with J&B RV Ranch and pays the appropriate rental amount. Prospective buyers may apply for entrance into the RV Park prior to purchase to examine an RV that is for sale.
Visitors are not permitted into the RV Park after 11:00pm without express consent by J&B RV Ranch obtained beforehand. All overnight visitors must park their cars by the office.
No guest, invitee, or visitor of a Guest may camp or sleep outside in their cars.
No more than one RV and two vehicles per rental space are allowed.
No inoperable or unlicensed vehicles will be allowed to remain in the RV Park. Guests shall not use or allow the use of their respective rental space for performance of major mechanical or long-term repairs.
No Guest is allowed to operate or conduct a business of any kind including a home occupation business within the RV Park. Garage sales or estate sales cannot be held within the RV Park without the express prior consent obtained by management of B squared Park. Garage /estate sales which are approved by J&B RV Park can only be held on the circle of grass in front of the RV Park, with someone designated to direct traffic and parking. No garage or estate sales may be conducted within the actual confines of the RV Park itself.
In order to enhance the quality of the RV Park and its aesthetic appearance, the management of J&B RV Park may refuse to rent to any Guest and J&B RV Park, at its discretion, may require a Guest to remove an RV which is in run-down condition or disrepair, and to vacate the RV Park.
To the extent laundry facilities are made available to Guests, no clothes lines shall be permitted in the RV Park except at the Laundry and articles of clothing or linens, towels, etc. shall not be hung, laid, or otherwise placed outside Guest’s residence to be dried. No washing or drying machines are permitted to be stored outside of the RV.
J&B RV Park and its management will not accept mail delivered to the RV Park for Guests or RV occupants. Guests must obtain a post office box or have their mail sent “general delivery” to the post office.
Guest, including Guest’s visitors, guests, and invitees, are prohibited from smoking in any of the J&B RV Park buildings including the clubhouse, laundry room, front office, etc.
Guest must clean up the clubhouse after use by Guest and or Guest’s visitors, guests, and invitees.
Guests are not allowed to trim any of the trees in the RV Park without the prior written consent of J&B RV Park.
Guests are not allowed to make repairs to the RV Park or any property of the RV Park.
Guests must keep their rental area and exterior of their RV clean and tidy. No personal property or debris is allowed to be stored on the pad around the RV which would be deemed by management to be an eyesore, specifically including but not limited to refrigerators and freezers, A/C units, satellite dishes, washing/drying machines. In the event Guest fails to keep their rental space clean and free of debris, J&B RV Park may issue a notice of non-compliance and if Guest fails to clean its rental space with three (3) days, then Guest will be deemed to be in default of the Agreement and J&B RV Park will be entitled to pursue the default remedies set forth in the Agreement.
Guests, including their visitors, guests, and invitees are not allowed to park on either the grass or the streets.
Campfires are allowed in portable, covered fire pits only, and not on the grass. Please do not put ashes in any trash receptacle.
Guest is not allowed to construct or place any outside storage units on the rental property without the express written consent of J&B RV Park.
All Guests who have pets are required to disclose and identify their pets to J&B RV Park management and all Guests are required to sign the Agreement acknowledging their compliance with the specified pet rules and regulations.
